It is amazing that despite his most serious injuries that he is still alive. The Salt Lake Tribune explains the tragic event stating that Dean had driven on the gravel pit’s edge in West Valley City, Utah at 6800 West and 5400 South, when his vehicle began to tip over the 40-foot grade. While the bulldozer was rolling, Dean was ejected and was pinned down by the heavy machine. It wasn’t until firefighters came to his rescue that he was able to escape the traumatic scene. Out of respect for his family&#8217;s request, the specific information on his injuries is being withheld.</p>
<p>Workplace injuries that were caused by a worker&#8217;s negligence or that of a co-worker are typically handled through the Utah Workers Compensation Fund. If a third party, i.e., someone besides the employee or co-worker contributed to the injury, then there very well could be a claim against them. The family of this man would be well advised to speak with a Utah accident attorney to find out what options might be available to them.</p>

This fatal accident happened on Sunday, June 28, 2010. The carnival closed at around 10 p.m. and at about 12:30 a.m. three workers, including Nutsch, were taking down the Ferris wheel . Mr. Nutsch somehow got himself stuck under the motors of one of the rails on the Ferris wheel. He was pinned there and passed away from his injuries. This incident is still under investigation but it appears it will just be ruled at accident, <a href="http://www.fox13now.com/news/local/kstu-tragic-accident-kills-carnival-worker-west-valley-city-westfest,0,3385944.story">reports Fox 13</a>.</p>
<p>I offer my condolences to Mr. Nutsch&#8217;s family in this sad accident.</p>
<p>Legally speaking, it is not clear if the family of Mr. Nutsch has a claim for his wrongful death. If the injury was caused by Mr. Nutsch himself or a co-employee, then his exclusive remedy would probably be a worker&#8217;s compensation claim. However, if a non-employee contributed to this accident, or if there was not workers compensation insurance carried for him, then there could be the possibility that a civil action could be brought against those responsible.</p>

The driver hit the man and took off. According to <a href="http://www.ksl.com/index.php?nid=148&amp;sid=8443926">KSL news</a>, the driver was traveling south on 1-215 near 3300 South around 7:30p.m. Sunday, October 25, 2009. The workers were standing in the lane nearest the shoulder that was coned off. According to the Utah Highway Patrol, the truck entered the coned off lane going 40 to 50 miles per hour and struck one of the workers from behind and kept going.</p>

<p>The victim has been identified as 20-year-old Brayden Beddoes. He was rushed to hospital where he later died. Witnesses say the truck was blue and white– possibly an old Dodge. Troopers suspect the truck suffered significant damage.  If you have any information on the whereabouts of the driver or truck, please contact authorities.</p>
<p>This is a horrible <a href="http://ronkramerlaw.com/construction-accidents/">Utah construction accident</a> that claimed that life of an innocent man. I offer my condolences to the family of Mr. Beddoes.</p>
